Conditions of contract of carriage

Carrying contraband is strictly prohibited. Violators will be sent to relevant units, and relevant accounts will be terminated in time. The consignor and our company, as the carrier, need to acknowledge the following clauses as agreed conditions to be complied with and have legal effect. The consignor accepts and abides by the terms of this contract upon payment of the freight.


一、
Responsibilities and Undertakings of Shippers and Carriers: 

1. The consignor and its entrusted agent guarantee that the consigned items conform to the national laws and can be accepted by the transportation department, and do not violate the will of the carrier. The company, the carrier, refuses to carry the following items: 

1) Dangerous goods such as flammable, explosive, perishable or toxic, explosive, lethal, corrosive and radioactive

2) Drugs or drug related equipment

3) Articles that infringe trademarks, copyrights or property rights

4) Currency, value-added tax invoices, other tax invoices or securities, gold and silver treasures, antiques, precious metals

5) Live animals, plants or seeds

6) Letters of a correspondence nature

7) Prohibited items subject to customs import control.

8) Goods that do not comply with the relevant government administrative regulations, departmental regulations and mandatory standards of the place of shipment and destination

9) Goods that need to be refrigerated

2. The shipper promises that the company has the right to give up or refuse to accept items that are not suitable for express transportation, intentionally or unintentionally conceal the real name and value of the items, and items that are expressly prohibited by national laws from being carried, mailed, and transported. Once violated, the consignor is willing to bear all legal and economic compensation liabilities arising therefrom.

3. The shipper and its entrusted agent guarantee to accept and pay the freight rate and related storage, return and transshipment fees announced by the company.

4. If any liquid or solid is spilled, seeped, or leaked from the shipper's goods, or due to various factors such as improper packaging of the goods or the goods themselves, resulting in contamination or damage to other goods, the company has the right to pursue the shipment. All legal and economic compensation liabilities.

5. The Giant Shipping Philippines special line only accepts and processes one waybill number and one packaged shipment (which can include multiple items in the store). If the seller provides a waybill number, but sends out two or more packaged shipments, the Giant Logistics Philippines collection warehouse will reject the relevant shipments or sign for them. If there is any loss, the company will not be liable for any compensation. the

6. Once the shipment is signed for at the giant consignment warehouse in the Philippines, if it needs to be returned or forwarded to other places in the country, the freight will be charged separately, and the freight is subject to the customer service quotation on the day. The

7. If any of the following situations occur, resulting in any loss, missed delivery or changes in shipping costs, Giant Logistics Philippines Special Line will not be responsible for:

Situation 1: The seller issued a waybill number, but there were two or more customers' goods in the package, which caused some customers to fail to claim other goods.

***The customer needs to contact the seller to ensure that the waybill number on the seller's shipment is only for the customer's goods. ***

Situation 2: (customer purchases two or more goods) The seller only provides one waybill number to the customer, but in fact the seller sends the customer's goods with two or more waybill numbers, which causes the customer to fail to claim other goods. the

*** It is the customer's responsibility to contact the seller to obtain another correct tracking number for claiming. ***

Situation 3: If the seller provides the wrong waybill number, the correct waybill number has passed the 60-day free storage period. A storage fee will be charged. the

*** It is the customer's responsibility to contact the seller to obtain the correct waybill number for claiming and to negotiate with the seller on the storage fee. ***

8. Within 60 days from the day when the goods are sent to the Giant Logistics Philippine warehouse, the customer must log in to the Giant Logistics Philippine special line to claim and choose the combined express service (contact the Giant Logistics Philippine special line customer service staff to apply for transportation), , otherwise a storage fee of 5 (RMB) will be charged per item per day starting from the 61st day.
9. The shipment must be sent within 90 days after arriving at the giant collection warehouse in the Philippines, otherwise it will be treated as waste and handled by the company itself, and the owner must not have any objections.

10. If it is less than 1 kilogram (KG), it will be calculated as 1 kilogram (KG).

*** Example 1: The total weight of all goods is 0.99 kilograms (KG), and the order will be calculated as 1 kilogram (KG). ***

*** Example 2: The total weight of all goods is 1.01 kilograms (KG), and the order will be calculated as 2 kilograms (KG). ***

11. The unit of weight calculation is kilogram (KG), and the accuracy is one decimal place, that is, 0.1 kg is the lowest scale.

12. The receiving time of the giant container shipping warehouse in the Philippines is 9:00am to 6:00pm from Monday to Saturday. Please refer to the latest announcement for the settlement time.

13. Due to the fact that foreign delivery and transportation companies are closed on Sundays or public holidays, the delivery of giant container shipping warehouses in the Philippines will be suspended on public holidays. If there is any change, the company's announcement shall prevail.

14. The logistics company will not deliver goods on Sundays or public holidays.

15. The weight and size of all shipments are subject to the actual warehousing data. The billable weight is based on volume weight or actual weight, whichever is greater, volume weight = length * width * height / 6000, the unit is cm, and less than 1KG is calculated as 1KG.

***Volume weight is a calculation method that reflects the density of the package. Over volume means that the volume is heavier than the actual weight***

The right to know about the goods being carried

1. The company has the right to know the nature, product name, quantity and weight of the goods being transported, so as to assist the relevant government departments and transportation departments to inspect or investigate the transported goods.

2. The items entrusted by Giant Consolidation Philippines Special Line will be randomly sampled and inspected. If it is found that the item does not meet the requirements of the "Terms of Carriage Contract", the company will refuse to carry it.

The right of retention of the goods being transported:

1. If the consignor and its authorized agent fail to pay the freight and related expenses payable in accordance with the provisions of the contract of carriage, the carrier has the right to retain the goods carried and retain the responsibility for the consignor and its authorized agent before obtaining effective guarantee. person's right to claim compensation, and shall not be liable for any loss arising therefrom.

2. The shipment must be sent within 90 days after it arrives at the giant collection warehouse in the Philippines, otherwise it will be treated as waste and handled by the company itself, and the owner has no objection.

 Disclaimer :

1. The company is not responsible for the delay, loss, destruction or confiscation of items caused by force majeure, such as customs inspection, war, riots, bad weather, flight delays, crashes, typhoons, fires, floods, major traffic accidents and natural disasters Or man-made serious disasters and various situations beyond the control of the company, or confiscation caused by the consignor's reasons are not responsible.

2. The company shall not be liable for any indirect losses or other non-subjective losses caused by delays or losses in the delivery of items.

3. The company is not responsible for the delay in delivery of items, delivery errors and losses caused by the following reasons:

1) Due to the sender's reasons, such as providing wrong, incomplete, and wrong phone numbers, etc.; the recipient's address has changed or the region cannot be delivered, etc.

2) Because the items entrusted by the consignor violate the relevant national policies and laws and regulations, such as flammable, explosive, easy to pollute, easy to corrode, poisonous powder, water and other dangerous goods.

3) Various losses caused by the shipper's undeclared and improper packaging.

4. Since the company's logistics service is based on the packaging of the received goods, they are combined and sent out, so if the goods themselves are not properly packaged, do not meet the requirements for safe transportation of goods, or special substances (such as Important items, fragile items, etc.) shall be marked to the company, and the damage and responsibilities arising therefrom shall be borne by the shipper.

5. In order to protect the rights and interests of customers, in addition to inspecting the transported items at the request of the government department and the transportation department or the company's regular random sampling survey, the company's domestic logistics transfer station will not sign for the customer when receiving the goods. Unpack the package for item quantity check or quality inspection. The company does not assume any liability for compensation for losses caused by the quantity, nature and characteristics of the items.


五、

Handling of lost parts

1.In case of lost shipments, please email to ph@titan-buy.com to check. If it is found that the shipment is lost due to logistics problems, the compensation amount will be up to three times the shipping fee.

2. The scope of protection only covers Giant Consolidation's collection in the Philippines to the designated address of the destination.

3. Does not include domestic shipments to the giant collection warehouse in the Philippines.

For email applications, the company will decide whether to make compensation after review. The upper limit of compensation is three times the shipping fee, and does not exceed the actual value of the goods.

 

5. Any claims must be reported by emailing the following information to our customer service email address ph@titan-buy.com within 24 hours of receipt.

B. Screenshot of proof of purchase

C. Customer contact number

E. If it is sent to the designated address, the relevant proof of address must be submitted

F. Photos of the outer packaging at the time of receipt (with a clear tracking number)

6. If the declaration is overdue, the company will consider that the delivery has been completed according to the regulations and will not be accepted.

7. After arriving at the port, after the lost item is found, our company will arrange to resend it. The found item is not within the scope of compensation and will not be compensated.
8. In case of any dispute, the company reserves the right of final decision.

 

六、

Damage treatment:

1. The customer is obliged to have good communication with the seller to ensure that the goods carried have sufficient durable support, strong toughness and sufficient thickness of the inner and outer packaging or containers, so as to avoid damage or loss of goods due to improper packaging during transportation; The box or outer packaging with sufficient and suitable protective materials shall be integrated with the protective materials, cushioning materials and contents of the goods; if there are multiple contents, there shall be no gap between the contents and the inner wall of the outer packaging. A sound made by rubbing, bumping, squeezing, or shaking. The company will not make any compensation for any damage to the package due to inconsistent packaging or fragile goods during delivery.

Detailed Rules for Logistics Claims:


1. After confirming that the claim case is established, it generally takes about 10 working days to complete the compensation.

2. All compensation amounts are settled in RMB.

3. All compensation amounts will be transferred to the account of Giant Consolidation, and transfers to other accounts will not be accepted for refund.


八、

Freight payment:


1. Order freight payment supports WeChat, Alipay, paypal, Alibaba, BDO bank card payment

2. In case of any dispute, Giant Logistics Philippines reserves the right of final decision.


九、

the customer's receiving address:

 
1. Logistics companies will not deliver goods on weekends or public holidays.

2. In order to protect customers, the logistics company will only deliver the goods according to the address on the order.
3. Address cannot be changed after order confirmation

4. If the customer provides other work or residential addresses other than the recipient's own, the company will not be responsible for any problems in the delivery of the goods.
5. Delivery area: Delivery can be arranged free of charge in the urban area of Manila, and addresses outside the urban area need to be consulted separately.
